Terms of Service

These terms are an agreement between you and NovoTract Holdings LLC, a Wyoming limited liability company doing business as NovoTract Consulting ("we", "us"). They cover this website and every consulting service we provide. By booking or paying for a service, you agree to them. Please read them, and the Refund and Cancellation Policy and the Privacy Policy, which form part of them.

1. What we offer

We help people who want to buy land or a house in the United States understand what they are buying and how the purchase works. Our services are:

• Strategy session: a 60-minute video or phone call about your goals, budget, where and what to look for, and how the buying process works, followed by a written summary.
• Property review: research into one specific property you are considering, covering matters such as zoning, access, utilities, flood zone, taxes, recorded restrictions and comparable sales, delivered as a written report and a 30-minute call.
• Purchase guidance: support through one purchase for 30 days, including a strategy session, reviews of up to three properties, a pre-closing checklist and email and phone support.

The exact scope, what you will receive, the timing and the fee for each engagement are set out in a written quote that we send you before you pay. If the quote and these terms differ, the quote governs that engagement.

2. What we are not

We work from public records, information published by government bodies and other third parties, and what you tell us. Those sources can be incomplete, out of date or wrong, and records change. Our findings describe what we found on the date we looked. Before you buy, you should confirm anything that matters to your decision with the appropriate licensed professional, such as a title company, a real estate attorney, a surveyor or an inspector. Every decision to buy, and on what terms, is yours.

We do not guarantee any result: that a property is suitable, that a purchase will close, that a price is fair, or that a property will hold or gain value.

3. Property we own or buy

NovoTract Holdings LLC may buy, own or sell real estate for its own account. We will not advise you on a property that we, or a company related to us, own or are trying to buy without telling you so in writing first. We do not sell property to our consulting clients, and we do not accept payment from sellers, agents or lenders for recommending them to you.

4. Quotes, fees and payment

• All fees are in US dollars (USD) and are stated in your written quote. A quote is valid for 14 days unless it says otherwise.
• Fees are paid in advance, by credit or debit card, through a secure payment page provided by Stripe, Inc., our payment processor. Your card details are entered on Stripe's page and are never received or stored by us.
• Charges appear on your card statement as NOVOTRACT.
• Our fee does not include third-party costs such as title searches, surveys, inspections, recording fees or attorney fees, which you arrange and pay for separately.
• The first 15-minute introductory call is free of charge. It carries no obligation, and we never ask for payment details on it.

5. Scheduling and delivery

All services are delivered remotely, by video call, phone and email. Nothing is shipped. How and when each service is delivered is set out in the Refund and Cancellation Policy and in your quote. Our timing depends on you sending us the property details and information we ask for; if they arrive late, delivery moves back by the same amount.

6. Cancellations and refunds

You can cancel and receive a refund as set out in our Refund and Cancellation Policy. If we cannot deliver a service we have been paid for, we refund it in full.

7. Your responsibilities

• Give us accurate and complete information, and tell us about anything you know that affects the property or your plans.
• Use our reports and advice only for your own decision about the property concerned.
• Use our services lawfully, and only for property you are genuinely considering buying.
• Be at least 18 years old, and able to enter into a binding agreement.

8. Reports and materials

The reports, checklists and summaries we prepare for you are for your personal use in connection with the purchase they relate to. You may share them with your family and the professionals helping you. You may not sell or publish them. We keep the right to reuse our general methods and know-how, but never your personal information or the details of your purchase.

9. Confidentiality

We keep what you tell us confidential and use it only to provide our services, except where you ask us to share it or the law requires it. The Privacy Policy explains how we handle personal information.

10. Disclaimer of warranties

We provide our services with reasonable care and skill. Apart from that, and to the fullest extent permitted by law, our services and this website are provided "as is", and we disclaim all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOVOTRACT HOLDINGS LLC AND ITS MEMBERS, MANAGERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFIT, LOSS IN THE VALUE OF ANY PROPERTY, OR LOSS ARISING FROM A DECISION TO BUY OR NOT TO BUY, WHETHER BASED IN CONTRACT, TORT OR ANY OTHER THEORY.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO ANY SERVICE WILL NOT EXCEED THE FEES YOU PAID US FOR THAT SERVICE.

Some states do not allow certain exclusions or limits. Where that is the case, they apply only to the extent the law allows, and nothing here limits liability for fraud or for anything that cannot lawfully be limited.

12. Indemnity

You agree to indemnify NovoTract Holdings LLC against any claim, loss or expense, including reasonable legal fees, arising from information you gave us that was false, or from your use of our reports in breach of these terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. If you have a complaint, please contact us first so we can try to put it right. Any dispute that cannot be resolved that way will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Nothing here affects your right to dispute a card charge with your card issuer.

14. General

If any part of these terms is held unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver of it. We may update these terms; the effective date at the top will change when we do, and the version in force when you accepted your quote applies to that engagement.
